Our law firm had recent success in bringing a suit for violation of the Colorado Fair Debt Collection Practices Act against a local debt collector who filed and obtained a default money judgment against our client. In Colorado, the deadline to file a lawsuit on most consumer debts is six years. If the consumer is sued on a debt that is more than six years old, he may not only have a complete defense to the underlying claim, but may be able to assert a counterclaim against the creditor for violating the fair debt laws.
